Abstract

Abstract: This article discusses the rejection of a polygamy permit at the Malang Regency Religious Court. This article is the result of research on the decision of judge number 0531/Pdt.G/2014/PA.Kab.Mlg. This research is qualitative and is a library in nature. The data obtained were analyzed by the deductive method. The results of the study concluded that in number 0531/Pdt.G/2014/PA.Kab.Mlg, the judge rejected the request for a polygamy permit because the Petitioner did not meet the requirements stipulated by law for polygamy. Even though the Respondent expressed no objection if the Petitioner had polygamy, the Petitioner had also stated that he was able to act fairly, however, because the cumulative requirements, namely the Petitioner's economic capacity were not fulfilled, the panel of judges rejected the application for a polygamy permit.

Abstrak: Artikel ini membahas penolakan izin poligami di Pengadilan Agama Kabupaten Malang. Artikel ini merupakan hasil penelitian terhadap putusan hakim nomor 0531/Pdt.G/2014/PA.Kab.Mlg. Penelitian ini adalah penelitian kualitatif dan bersifat pustaka. Data yang didapat dianalisis dengan metode deduktif. Hasil penelitian menyimpulkan bahwa dalam putusan nomor 0531/Pdt.G/2014/PA.Kab.Mlg, hakim menolak permohonan izin poligami termohon dengan pertimbangan bahwa Pemohon tidak memenuhi syarat-syarat yang telah ditentukan oleh undang-undang untuk Poligami. Meskipun Termohon menyatakan tidak keberatan apabila Pemohon berpoligami, Pemohon juga telah menyatakan sanggup berlaku adil, namun oleh karena syarat komulatif yaitu kemampuan ekonomi Pemohon tidak terpenuhi maka majelis hakim menolak permohonan izin poligami. Putusan tersebut telah sesuai dengan peraturan dan undang-undang yang berlaku di Indonesia.
