Hubungan Hukum Internasional dan Hukum Nasional

Abstract: International law is generally shown to govern the relations of states in an international arrangement. National law is a law that applies exclusively to the territory of a sovereign state. International law is much influenced by National law, therefore their relationship to one another must be obeyed. The rrelationship between national law and international law has two views, the first is dualism which states that international law and national law combine and create new law. The second is monoism which states that national law is abolished and must follow international law voluntarily.

Abstrak: Hukum internasional pada umumnya ditunjukkan untuk mengatur hubungan negara-negara pada tatanan internasional. Hukum nasional ialah hukum yang berlaku secara eksklusif dalam wilayah suatu negara berdaulat. Hukum internasional banyak dipengaruhi oleh hukum nasional, oleh karena itu hubungan antara mereka satu dengan yang lainnya harus ditaati. Hubungan hukum nasional dan hukum internasional memiliki dua paham, yang pertama yakni paham dualism yang menyatakan hukum internasional dan hukum nasional bergabung dan menummbuhkan aturan hukum baru. Yang kedua yakni paham monoism yang menyatakan hukum nasional dihapus dan harus mengikuti hukum internasional secara voluntarism (sukarela).
